The following information is provided to assist in filing foreclosures in Garfield County.
We accept e-filings submitted through GTS or e-mail for foreclosures filed pursuant to C.R.S. §38-38-101 (2).
In addition to the paper file, please e-mail either a data sheet with all foreclosure data used to prepare your documents or the combined notice in .doc or .wpd format. These are used only to copy and paste your information into our computer system. Copies of e-mailed documents do not need to be included with the paper files. Please identify all correspondence with your file number.
It is necessary to mail a check for all required deposits and/or additional fees. We do not consider a file complete until we have received all documents AND the full amount of the required deposit. Those files submitted by email will be rejected back to the sender if a deposit is not received within 10 business days of file submission.
Files are reviewed for acceptance no later than the 10th business day after the later of;
- receipt of the total required deposit, or;
- receipt of the required documents.
Foreclosures are generally recorded Mondays, Thursdays and Fridays. Sales are always scheduled for Wednesdays. Notification of missing or incorrect documentation will be sent via e-mail if a file is rejected. Upon receipt of corrected documentation, files will be placed back in the queue of new files. The file and deposit may be returned to the submitter if corrections are not received in our office within five business days of notification.
After the Notice of Election and Demand has been recorded, a transmittal or e-mail setting forth the sale number, sale date, expected publication dates, etc., will be sent to the foreclosing attorney’s office. Copies of file documents may be viewed in the Public Trustee’s database of the Garfield County website.

**Assignments of Certificates of Purchase and/or Certificate of Redemption must be dated or received by Public Trustee prior to the statutory vesting of title. Unrecorded assignments will be recorded by Public Trustee and fees to record must be included with your request for deed. Deeds will not be issued until all foreclosure fees have been paid.
