Protest filed for RE-2 school board recall election

A protest hearing has been set for March 27 in Glenwood Springs

PRESS RELEASE
March 18, 2024

A protest was filed on March 11 to the Garfield County Clerk and Recorder’s Office regarding a community recall effort to remove Garfield County School District Re-2 Board of Education Director of District E Tony May from his seat.

Garfield County has retained an independent officer, Ms. Sheila Reiner of Desert Vista Consulting, LLC, of Mesa County, to administer a protest hearing and decide whether the protest is valid and if a recall election will be scheduled. Pursuant to Colorado Revised Statutes (C.R.S.) 1-12-108 (9)(a)(II), the protest hearing is set for March 27, 2024, at 1 p.m., in the Garfield County Board of County Commissioners hearing room at 108 8th Street, Glenwood Springs.

A recall petition had been filed with the clerk’s office and a qualifying number of submitted signatures were deemed sufficient on February 29, pursuant to C.R.S. 1-12-108(9)(a)(I). This statute states that the verified recall petition is held as sufficient unless a “protest in writing under oath” is filed with the Garfield County Clerk and Recorder’s Office by an eligible elector within 15 days.

The conclusion of the hearing must be delivered within 30 days of the filed protest: April 10, 2024, per C.R.S. 1-2-108(9)(a)(III).
