Re-2 District E director recall petition ruled sufficient

Recall election may not take place within 60 days of a Presidential Primary

A recall petition for Garfield County School District Re-2 Board of Education Director of District E Tony May has been determined sufficient by Garfield County Clerk and Recorder Jackie Harmon. Pursuant to Colorado Revised Statutes (C.R.S.) 1-12-105, Recall and vacancies in office, the number of valid signatures required for the petition is 2,038 and the total number valid signatures submitted is 2,441.

No recall election can take place within 60 days of the Presidential Primary Election, which takes place this Tuesday, March 5.

Per C.R.S. 1-12-108 (9) (a) (I), the verified recall petition is held as sufficient unless a “protest in writing under oath” is filed with the Garfield County Clerk and Recorder’s Office by an eligible elector within 15 days.

C.R.S. 1-12-109, resignation, allows the recalled officer to offer his or her resignation within five days of the petition being found sufficient.

Per C.R.S 1-12-110 and C.R.S 1-12-111 (2), Harmon will announce a recall election when all state statutes are fulfilled (if a resignation is not tendered). She will then set the recall election date, which will be posted on the Garfield County website.
